It's a new tree for us looked great about two weeks ago, I thought maybe it was just in shock from the planting. Now I'm not sure. Some of the leaves are drying up and falling offf.

It sounds like a watering problem. New trees need to be regularly watered for their first year; especially if the weather is hot.

I agree with you Amblealice that it sounds like the effects of being planted and then being hit by the hot and dry weather.
There is however also a virus called 'Apple Scab' that can can have similar effect to what you have described on the leaves. It would probably be worth checking the RHS Website page about Appple Scab to see if if could be this.

This site helped me to understand that my cooking apple trees are infested with apple leaf miner.

I am pulling off all the damaged leaves and I spryed the tree with a solutin I made with neem oil and I am going to buy a light trap.
